These Terms and Conditions govern the use of this website and the purchase of original artworks, limited edition fine art prints and related services from Galerie Portraits. By placing an order or making an enquiry through this website, you accept these terms in full.

The website offers original artworks, limited edition prints, fine art editions, artist commissions, advisory services and related gallery services. Each product page specifies, where applicable, the medium, dimensions, edition number, price, availability, framing or finishing options, and any relevant production or delivery times.

3. Prices, Taxes and Currency

Prices are shown in euros (€). Unless expressly indicated otherwise, prices may exclude VAT, shipping, customs duties, import taxes or installation costs. The final applicable amount will be communicated before payment confirmation.

4. Ordering Process

For works available for direct online acquisition

1. Select the artwork or edition and review the product details carefully.
2. Add the selected works to the shopping cart.
3. Complete the billing and delivery information required to process the acquisition.
4. Confirm the preferred payment method and review the order details before final submission.
5. Once the acquisition process has been completed, a confirmation email will be sent automatically.

For enquiry-based acquisitions

1. Collectors may submit a request through the available inquiry or contact forms.
2. Galerie Portraits will confirm availability, final price, shipping method, and payment instructions where applicable.
3. The acquisition shall be considered formalised once payment has been confirmed or written confirmation of the order has been issued.

Payment may be made through the methods indicated during the acquisition process, including card payment, bank transfer, PayPal, or agreed instalment arrangements where available. For original works, commissions, or high-value acquisitions, Galerie Portraits may request a deposit prior to reserving or producing the work. All payments are processed through secure payment gateways designed to ensure the highest standards of confidentiality and transaction security. Galerie Portraits does not store complete credit or debit card details at any time.

6. Availability and Production Times

Limited editions and original works are subject to availability. Fine art prints may require production, quality control, signing, numbering and certificate preparation before dispatch. Estimated production and delivery times are indicative and may vary depending on format, framing and destination.

7. Shipping and Delivery

Shipping conditions, packaging standards, delivery times, insurance and customs information are detailed in our Shipping & Delivery policy, which forms part of these Terms and Conditions.

8. Right of Withdrawal and Returns

Consumers have the right of withdrawal where legally applicable. The conditions, exceptions and procedure are explained in our Right of Withdrawal policy. Custom-made works, personalised commissions and bespoke framed works may be excluded from withdrawal where permitted by law.

9. Intellectual Property

The purchase of an artwork transfers ownership of the physical work or edition only. It does not transfer copyright, reproduction rights, image rights, or any other intellectual property rights unless expressly agreed in writing. Any reproduction, distribution, publication, modification, or commercial exploitation of the artworks or their images is strictly prohibited without the prior written authorization of Galerie Portraits and/or the artist.

10. Liability

Galerie Portraits is not liable for delays caused by carriers, customs authorities, force majeure events or circumstances outside its reasonable control. This does not affect mandatory consumer rights under applicable law.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. Any dispute shall be submitted to the competent courts in accordance with applicable consumer protection rules.
