This policy explains when and how consumers may exercise the right of withdrawal in relation to purchases made through Galerie Portraits, in accordance with Spanish Royal Legislative Decree 1/2007 and applicable consumer protection rules.
Where the right of withdrawal applies, you have 14 calendar days from the day you or a third party indicated by you receives the artwork to withdraw from the contract without giving any reason.
To exercise the right of withdrawal, you must notify us before the end of the 14-day period by sending an unequivocal statement to info@galerieportraits.com including your name, order number, artwork purchased and your decision to withdraw.
The right of withdrawal may not apply to goods made to the consumer’s specifications or clearly personalised, including commissioned artworks, bespoke formats, personalised editions, made-to-measure framing or any work produced specifically for the buyer.
Original works or limited editions that have been altered, damaged, framed to order, installed or handled beyond what is necessary to inspect them may be subject to deductions or may not be returnable where permitted by law.
After notifying withdrawal, you must return the artwork without undue delay and in any event no later than 14 calendar days from the date you communicate withdrawal. The artwork must be returned in its original packaging, complete with certificate of authenticity, documentation, protective materials and accessories.
Unless otherwise required by mandatory law, the direct cost of returning the artwork is borne by the buyer. Returns must be made using an insured and trackable shipping service suitable for fine art. The buyer is responsible for loss or damage during return shipping until the work is received by Galerie Portraits.
Where withdrawal is validly exercised, we will refund the eligible amounts received from you using the same payment method used for the purchase, unless expressly agreed otherwise. We may withhold the refund until we have received the artwork back and verified its condition.
The buyer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the work. Works must not be displayed, installed, modified, damaged, exposed to humidity, smoke, direct sunlight or any harmful environmental condition before return.
